H-1B Visa: Specialty Occupations

The H-1B Visa allows U.S. companies to hire foreign professionals for roles in specialty occupations. These positions typically require a bachelor's degree or higher in fields such as information technology, engineering, mathematics, architecture, healthcare, and other skilled professions.

  • Eligibility: Applicants must possess a job offer from a U.S. employer in a specialty occupation and hold at least a bachelor's degree (or equivalent) in a relevant field.
  • Employer Sponsorship: The employer must file a Labor Condition Application (LCA) with the Department of Labor, certifying that hiring the foreign worker will not negatively affect U.S. workers and that fair wages will be paid.
  • Annual Cap: The H-1B program has an annual cap of 65,000 visas, with an additional 20,000 available for applicants who have earned a master’s degree or higher from a U.S. institution.
  • Duration: Normally good for three years, but may be extended for an additional three, for a total of six years.

E-3 Visa: Australian Specialty Occupation Workers


The E-3 Visa is available exclusively to Australian nationals, allowing them to enter the U.S. to work in specialty occupations that require specialized knowledge, similar to the H-1B visa but tailored for Australian citizens.

  • Eligibility: To qualify, the applicant must be an Australian citizen with a job offer from a U.S. employer in a specialty occupation. The role must typically require a bachelor's degree or equivalent experience in fields such as technology, healthcare, engineering, or finance.
  • Specialty Occupation: The position must involve the application of specialized knowledge, requiring a degree or equivalent in a specific field of study relevant to the job.
  • Duration: The visa is issued for an initial 2-year period and can be renewed indefinitely in 2-year increments, provided the applicant continues to meet the visa requirements and maintain employment in the specialty occupation.
  • Spouse Benefits: The spouse of an E-3 visa holder can apply for work authorization, enabling them to work in the U.S. without any job restrictions.

L-1 Visa: Intra-Company Transferees


The L-1 Visa is designed for employees of international companies who are being transferred to a U.S. office or are establishing one.

  • L-1A: For executives and managers transferring to the U.S. from a foreign office.
  • L-1B: For employees with specialized knowledge being transferred within the company.
  • Eligibility: To qualify, the foreign company must be related to the U.S. company (parent, subsidiary, affiliate, or branch), and the applicant must have worked for the company abroad for at least 1 year within the past 3 years.
  • Duration: Up to 7 years for L-1A, and up to 5 years for L-1B, with initial stays of 1 to 3 years and possible extensions.

R-1 Visa: Religious Worker

What Is the Duration of a Temporary Work Visa?

The duration of a temporary work visa in the United States can vary depending on the specific type of visa you hold. These visas are typically granted for a defined period, often linked to the terms of your employment or the purpose of your visit.

 

Below are a few temporary work visas and their durations:

  • H-1B Visa: Normally good for three years, but may be extended for an additional three, for a total of six years.
  • L-1 Visa: L-1A visas for managers and executives are initially given for three years and can be renewed for up to seven years. Employees on L-1B visas follow a similar trend.
  • O Visa: Granted for a three-year initial period with the possibility to extend in one-year increments.
  • TN Visa: Can be issued for up to three years and can be extended in three-year increments.
  • E-2 Visa: The duration depends on the specific treaty between the applicant's home country and the U.S. These visas can be issued for substantial but renewable periods, often in two to five-year increments.
