Mexican Nationals Petitioned by a U.S. Citizen Sibling on or before

April 30, 2001, Will be able to Apply for Permanent Residency Beginning August 2024!

After waiting more than 23 years, Mexican nationals physically present in the United States on December 21, 2000, who had a U.S. Citizen sibling file an immigrant visa petition on their behalf on April 30, 2001, will be eligible to file their application to adjust status in August 2024. This is the first time this priority date in this category has become current.

Section 245(i) of the Immigration and Nationality Act (INA), as amended in 2000 enables certain individuals who are present in the United States who may have entered unlawfully, worked without authorization, or failed to maintain lawful status to pay $1,000 and obtain lawful permanent residence (aka green card) IF they were the beneficiary of a labor certification application or immigrant visa petition filed on or before April 30, 2001. They also must demonstrate that they were physically present in the U.S. on or around December 21, 2000.
